AUGUSTA — A Farmingdale man who allegedly stole sign posts from a state garage and then sold them almost immediately to a recycler pleaded guilty Tuesday to four criminal charges in connection with that incident, but the two most serious charges against him will be dismissed if he complies with certain conditions.

Brock R. Hamilton, 27, entered guilty pleas in Kennebec County Superior Court to unlawful possession of scheduled drug, theft by unauthorized taking or transfer, criminal trespass and refusing to submit to arrest or detention, physical force.

All the events occurred April 27 through 29, 2013, in Augusta.

An affidavit by Officer Donald Whitten, of the Augusta police, says Hamilton was stealing the metal sign posts from a transportation department garage on Bog Road and then selling them at One Steel in Augusta, at one point less than an hour after they were taken.

Whitten says images of a vehicle Hamilton was driving were captured by a game camera.

Hamilton was arrested at an Augusta apartment two days after the theft and wrestled with police officers who subsequently found some packets of heroin on Hamilton, Whitten’s affidavit says.

If Hamilton completes conditions of a 12-month deferred disposition, he will be permitted to withdraw his plea to the theft and drug charges and will be sentenced to 364 days in jail, with all but 10 days suspended, and one year of probation, according to court documents.

He was ordered to pay $11,120 as restitution, and a condition of deferred disposition bans him from the state garage.

“The deferred disposition gives Brock a second chance,” said his attorney, Walter McKee. “If he is successful — and I’m sure he will be — he won’t have a felony conviction.”

In October, Hamilton had pleaded guilty to stealing copper wire from spools stored in a barn on Kerns Hill Road in Manchester. The offense occurred May 14, 2013, and at the time Hamilton told investigators he had been hunting in the area; however, an affidavit filed in the case by Kennebec County Sheriff’s Deputy David Bucknam indicated Hamilton had wire cutters and a utility knife on him. Investigators had set up a game camera to detect motion in the area around the barn, which led to Hamilton’s capture on the site, Bucknam said in the affidavit.

For that theft and a related charge of violating a condition of release, Hamilton was sentenced earlier to 30 days in jail.
