Incriminating statements made by a 2008 Winslow High School graduate facing two counts of second-degree murder in New Hampshire can be used against him in court, a judge there has ruled.
The New Hampshire Sunday News reported Sunday that Ricky Munster, 21 and now of Nashua, N.H., told police that he struck 51-year-old Mark Vallee with his hands, feet and a block of wood until he died after Vallee attacked him in Nashua on Memorial Day last year.
According to the newspaper, the affidavit quotes Munster as saying he attacked Vallee because he was “pissed off” at Vallee for attacking him after Munster tried to help Vallee. Munster said he saw Vallee fall on a city sidewalk touching the state’s border with Massachusetts.
Vallee was later found dead by a passer-by, lying in a pool of blood.
The newspaper said Munster, who has a criminal record in Maine and has been written up many times for disciplinary issues while in jail in New Hampshire, was being questioned then as a witness. He was arrested after making the statements.
However, the affidavit the interview was contained in had been sealed at Hillsborough County Superior Court in Nashua.
Judge Jacalyn Colburn recently denied the defense’s motion to suppress the affidavit. The trial is scheduled tentatively for October, according to the Sunday News.
